WELLNESS EVENT – WAIVER, RELEASE AND HOLD HARMLESS FORM

I hereby acknowledge and agree that:

I have signed up to participate in a wellness event(s) (“Wellness Event”) sponsored in whole or in part by Lifestyle Inspired Fitness Training, LLC (LIFT) and Bridge To Health LLC.

I recognize that the Wellness Event may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities. I also recognize that food, beverage and/or other consumable products (including alcohol) may be available at the Wellness Event. I am fully aware of the risks and hazards connected with the participation in the Wellness Event, including but not limited to, physical injury or death. I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition that would prevent or otherwise limit my full participation in this event.

I hereby elect to voluntarily participate in this Wellness Event knowing that the associated physical activity and/or consumable products may be hazardous to me and/or my property. I agree that by participating, I do so entirely at my own risk. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, AS A RESULT OF MY PARTICIPATION IN THIS EVENT.

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE each and every of the following individuals or entities, together with their respective owners, officers, directors, shareholders, members, subsidiaries, affiliates, partners, lenders, employees, agents, and all of their respective agents, successors and assigns:

Lifestyle Inspired Fitness Training, LLC; Bridge To Health LLC

The Location (defined above), including its building association(s) and management;

Individuals and Entities providing services and/or products for use at or in connection with the Wellness Event;

(collectively, the “Released Parties”), from any and all liability, claims, demands, actions, and causes of action whatsoever, including but not limited to negligence, arising out of or related to any personal and/or property loss, damage, or injury while participating in this Wellness Event, or while on or upon the premises of the Wellness Event Location.

This Waiver, Release and Hold Harmless shall be construed under the laws of the State of California. Any portion deemed by a Court of competent jurisdiction to be invalid may be modified and/or severed, as permitted by law, and the remainder shall remain in full force and effect.

I acknowledge and represent that I have carefully read and understand the foregoing, fully understand that it is a release of liability, and I hereby sign it voluntarily as my own free act and deed; no oral representations, statements or inducements, apart from the foregoing written agreements have been made. I hereby execute this waiver and release for valuable consideration, intending to be bound. By signing this release, I also acknowledge that I understand its content and that this release cannot be modified orally.

PARTICIPATION BY A MINOR

If the participant is a minor (under 18), this Waiver, Release and Hold Harmless must be signed by the child’s legal guardian.

BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM A RELEASED PARTY IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND RELEASED PARTIES HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
